Physiotherapists, podologists, optical-optometrists, logopedas, occupational therapists and nutritionists have reported that, in the face of the health alert situation, they have the obligation to close their private centers by force majeure and request that this circumstance be admitted as the cause of ERTS
The College Councils Physical therapists, Poeologists, Optics-Optometrists, Logopedas, Occupational Terapeutas and Nutritionists have requested the Ministry of Labour and Social Economy that the 'major force' is considered the cause of ERTE, to guarantee the maintenance of jobs. The Colegial Councils have confirmed that, in view of the health alert situation and the lack of necessary protection measures, they are bound by the obligation to close their private holding centres, for this reason.
After the request of these groups to be included among the establishments of compulsory closure, the government has not yet carried out this measure, but some Autonomous Communities, such as Castilla La Mancha, Galicia, Andalusia and Catalonia, are doing so. In order to deal with these closures, whether dictated by the Autonomous Communities, or because they do not have means of protection, these centres must take measures to suspend the employment contract by force mayor. There is currently a situation of disbanding protection measures such as mask and glasses, nitrile gloves, disposable robes, hydro alcoholic solutions and disinfection elements of all those utensils and machinery that are in contact with patients. Failure to have the necessary protection measures, pursuant to Law 21/1995 of 8 November, on the Prevention of Labour Risks, requires the suspension of the activity, either by self-will or by the imposition of the workers. Because of this circumstance these groups request that a guideline be issued to the labour authorities of the Autonomous Communities, which are the competent authority to evaluate the ERTs being presented by the professionals attached to these six Colegiales Sanitarios Councils and which admit as the cause of the ERTES the force majeure, for the center of direct attention to the public and to have lack of protection supplies, which prevent the continuation of the activity.
